New York City is under a state of emergency on Sunday as the country faces a shortage of specialty infant formula.
Mayor Eric Adams signed Emergency Executive Order 98 (EEO 98), declaring a state of emergency in New York City over the formula shortage.
The executive order will authorize the New York City Department of Consumer and Worker Protection (DCWP) to prevent price gouging for baby formula.
“The nationwide infant formula shortage has caused unimaginable pain and anxiety for families across New York — and we must act with urgency,” said Mayor Adams in a statement.
“This emergency executive order will help us to crack down on any retailer looking to capitalize on this crisis by jacking up prices on this essential good. Our message to struggling mothers and families is simple: Our city will do everything in its power to assist you during this challenging period,” he added.

The U.S. is in a baby formula shortage due mainly to the actions of Biden’s FDA. The head of the FDA now says that he is alright with opening the formula plant in Michigan, but the plant has not been given permission to produce the baby formula again. The firm, Abbott, reported that based on its investigations, it had done nothing wrong before the FDA shut them down.
The Biden administration announced Wednesday afternoon it is invoking the Defense Production Act and facilitating the import of infant formula to ease the shortages that have affected families nationwide and led to the hospitalization of children. However, the Biden administration waited until this week to take decisive action. The shortages have been occurring for months since the FDA shut down an Abbott plant in Sturgis, Michigan last February leading to shortages of about 40 percent of the nation’s supply of infant formula.

A military plane carrying over 78,000 pounds of specialty infant formula coming from Germany arrived in Indiana on Sunday to address the shortage in the country.
But the imported baby formula won’t be on store shelves, it will be distributed to areas that have been most affected by the shortages.
